It follows from the light of the above court decisions that the legality of contract law depends entirely on its nature and the terms of the contract. If the contractual terms are illegal or contrary to the general lake policy that is inappropriate, the treaty is considered “no” in the eyes of the law and cannot be enforceable in court. Let us return, for example, to the blackjack dealer: if his employer does not pay them for the work he did as a blackjack dealer, then the trader does not have the opportunity to recover his lost wages for the work, because the entire employment contract is illegal. The employer will be for breach of contract and payment to the employee off the hook, and the blackjack dealer will have no remedies available. Even if a treaty can legitimately rebalance, if the agreed goal is to do something illegal, the lack of knowledge of illegality does not excuse that from illegality. Somerfield terminated the contract prematurely, claiming that Parkingeye`s third letter was misleading and that it used illegal means to induce people to pay and therefore constituted an illegal act. On this basis, they stated that the illegality had rendered the entire contract unenforceable. The trial judge rejected this defence of illegality.

Somerfield, when the contract was terminated, was found to be a breach of refusal. Parkingeye was able to claim damages for revenue not due during the term of the contract that did not expire. Somerfield appealed. Therefore, even if the purpose of the contract is not expressly mentioned in any of the statutes, a court may treat them as if they were illegal if they created circumstances contrary to public policy. If such a scenario occurs, the court will not apply the contract. However, Parkingeye`s decision shows that the courts will take a commercial and pragmatic approach to illegality and, if it is found that there was no intention to execute the contract illegally from the outset, an unlawful action will not automatically render the contract unenforceable.
